The Bureau of Transportation Statistics (BTS) reported in 2017 that trade between the United States and its NAFTA (North America Free Trade Agreement) partners Canada and Mexico has grown since 2000, with trucks carrying 65.5 percent of the goods traded with these countries in 2016. Trade carried by highway carriers was largely responsible for the 85.3 percent increase in the value of imports from Mexico between 2000 and 2016.

 

Currently, Mexican tractors are restricted to a narrow commercial zone where Mexican truck shipments into the U.S. are required to use a transfer tractor. This transfer tractor picks up shipments from the Mexican border and into US territory. The typical commercial border crossing process requires the Mexican shipper to file cargo information data with both Mexican and U.S. agencies, prepare both paper and electronic forms, and use a drayage or transfer tractor to move the goods from Mexico to the U.S.

ACE EMANIFEST INITIATIVE

The Trade Act of 2002 required U.S. Customs and Border Protection (CBP) to start collecting electronic manifest data from trade participants in order to protect the country and its citizens while facilitating legitimate trade. Automated Commercial Environment (ACE) was implemented to serve as a single window for electronic data exchange between the government and trade participants.

 

As the primary commercial trade processing system in the U.S., ACE aims to enhance border security and expedite the flow of trade. An important part of ACE is providing the tools and information that CBP officers need to identify high-risk and compliant shipments before the shipment reaches the border. All shipments in all modes of transport must be declared to CBP electronically, including complete bill of lading information, via ACE.

 

Since 2007, truck carriers entering the U.S. via border crossings in Arizona, California, New Mexico and Texas have been required to transmit advance electronic cargo and conveyance information to CBP via ACE. CBP relies on information submitted by the carrier and the broker in the U.S. to determine admissibility.

 

The ACE highway eManifest capability is available at all ACE ports. Carriers coming from Mexico can monitor eManifest submissions, CBP messages and other shipment data from the ACE Portal. Carriers with an ACE Portal account can track the status of every trip, generate a wide variety of reports, identify trends for future planning, and improve existing processes. eManifest allows carriers to start import procedures early and drivers to reduce time spent at the border, expediting deliveries and allowing them to haul more shipments.

 

ACE HIGHWAY EMANIFEST FOR MEXICO: REQUIREMENTS AND PROCESSING

The ACE highway eManifest is divided into five areas of information: cargo, conveyances, equipment, shippers and consignees, and drivers/crew. The carrier can add drivers, trucks, and trailer information in the ACE Portal for easy retrieval during eManifest preparation. FAST carriers who register for ACE will automatically have their FAST-approved crew and conveyance information transferred to ACE.

 

All highway carriers, including shippers who operate their own trucks, are required to register with CBP to participate in ACE. Upon registration, the carrier is assigned an ACE number and given access to the ACE Portal. When a truck from south of the border approaches the primary booth, technology is used to signal the truck's arrival. The border officer retrieves and reviews the eManifest in the system along with the broker’s entry filing, in-bond requests and other release declarations. Whether the truck is referred to secondary for examination or released immediately depends on the type of merchandise, the information in the eManifest and participation of the carrier and driver in programs like C-TPAT.

 

CBP recommends that all truck drivers crossing the border have a complete set of printed documentation in a sealed envelope to be given to the customs officer when requested or when the eManifest system is down. The eManifest lead sheet must contain the barcoded trip number and relevant information, especially if the truck crosses the border more than once a day.

ACE HIGHWAY EMANIFEST SUBMISSION

ACE highway users in Mexico follow the same eManifest submission process as northern truckers. Highway carriers in Mexico can submit eManifests through the web-based ACE Portal or via CBP-approved electronic data interchange (EDI) third party service such as Global eTrade Services.

 

ACE Portal

 

The ACE Portal is essentially a website that connects CBP and the trade community. The ACE Portal is a single online access point for communication, where data can be stored, edited and reused to save time and reduce data entry. When creating eManifests on the ACE Portal, carriers must enter information for each truck, trailer, driver, and shipment details for each trip. This takes about 30 minutes to complete for each truck per trip.

 

The Portal, however, is not intended for high-volume carriers. In the Portal, only one eManifest at a time can be prepared and filed, making it impractical for businesses that handle large volumes of shipments every day. High-volume carriers use EDI transmission for this reason.

 

Electronic Data Interchange (EDI)

 

EDI is the primary method of electronic data exchange between traders and CBP. EDI is a system-to-system method of data exchange using specific messaging standards. CBP will validate and process information sent to ACE via EDI. Unlike the ACE Portal, EDI allows highway carriers to prepare, edit and submit multiple eManifests at the same time. EDI is also the main eManifest transmission method for rail, air and marine carriers.

 

EDI transmission directly from your own computer system to CBP requires a secure data transmission connection and custom programming to create the appropriate electronic message.
